A fourth generation lawyer continuing his family tradition of distinguished legal representation, François garners over thirty five years of experience and has been in his current role with Miller Thomson for the past thirteen years. He specializes in labor and employment law. Mr. Garneau has successfully represented employers, senior executives and professionals before the courts. In recent years, he has obtained judgments against government agencies, major employers and trade unions, all of which were confirmed in appeal.
For more than 25 years, he has advised numerous employers on matters related to termination of employment, collective bargaining, grievances, strike and lock-out management, employment policies, ethics and the prevention of violence and harassment in the workplace. In 2014, he obtained from the Administrative Tribunal of Quebec the reversal of a decision of the Quebec Health Board which had refused to cover the medical costs incurred by a Quebec citizen for a cancer treatment and liver transplant which was performed at the Mayo Clinic in Rochester, Minnesota thus enabling the patient and his family to recover more than $500,000 in medical expenses. This Summer, the Quebec Court of Appeal maintained a judgment of the Quebec Superior Court which had ordered the controlling shareholder of an employer to pay close to $2,000,000 to a former senior executive who had been prevented from exercising his vested options as a result of his unlawful termination; Mr. Garneau represented the executive before the Superior Court and the Court of Appeal.
Mr. Garneau also represents victims of discrimination and harassment in the workplace. He is also a recognized specialist in the field of constructive dismissal and obtained one of the biggest constructive dismissal damage awards including moral and punitive damages for discrimination in the case of Chalifour vs. IBM.
A member of the Canadian Bar Association and Barreau du Québec, François obtained his L.LL. degree from the Université de Montréal. He has lectured on numerous topics related to employment and labour law. His article on Constructive Dismissal in Quebec was published in the McGill Law Journal.
